Highlights from the 2021 Adam F. Fanaki Competition Law Moot

On March 26 and 27, 2021, the Competition Bureau, Competition Tribunal and Canadian Bar Association joined forces to lead the third annual Adam F. Fanaki Competition Law Moot.

Due to the ongoing COVID-19 pandemic, the oral rounds of the moot and social events were held entirely on a virtual platform. Engaging in oral advocacy by video is challenging for the litigators as well as the judges. Some elements of virtual advocacy may outlive the current exceptional circumstances, so this moot provided novel and valuable experience for the students who participated in the competition.

30 budding lawyers from seven Canadian law faculties tackled a complex merger problem:

  • Osgoode Hall Law School at York University

  • the Peter A. Allard School of Law at the University of British Columbia

  • Queen's University Faculty of Law

  • the University of Alberta Faculty of Law

  • McGill University Faculty of Law

  • the University of Toronto Faculty of Law; and

  • the University of Windsor Faculty of Law

Judging panels made up of distinguished members of the judiciary, academia, the competition bar and the public service evaluated the written and oral submissions made by the students.

The organizers would like to thank the participants, judges, and all those who supported the 2021 moot.

Highlights from the 2020 Adam F. Fanaki Competition Law Moot

In March 2020, amidst the global COVID-19 pandemic, the Competition Bureau, Competition Tribunal and Canadian Bar Association joined forces to lead the second annual Adam F. Fanaki Competition Law Moot remotely. While the oral rounds and awards gala were cancelled due to the COVID-19 pandemic, law students from across the country had submitted written arguments in January and February. Recognizing that students, coaches and faculties dedicated significant time and effort to draft these submissions and prepare for the oral rounds, scores and feedback were provided to the teams to the extent possible given the circumstances.

This resilience and sense of innovation enabled 30 budding lawyers from seven Canadian law faculties to tackle a complex abuse of dominance problem:

  • Osgoode Hall Law School at York University,

  • the Peter A. Allard School of Law at the University of British Columbia,

  • Queen’s University Faculty of Law,

  • the University of Alberta Faculty of Law,

  • the University of Ottawa Faculty of Common Law,

  • the University of Toronto Faculty of Law, and

  • the University of Windsor Faculty of Law,

A special thank you to our panel of judges:

A panel of esteemed judges from academia and the competition law bar evaluated the written submissions: Kate McNeece and Stéphanie St-Jean of McCarthy Tétrault LLP, and Associate Professor Jennifer Quaid, University of Ottawa Faculty of Law.
